E-BILL EXPRESS

By creating an account within E-Bill Express, you are agreeing to the following terms of service:

Description of Service: E-bill express is an online platform for members of the Social Service Contractors Indemnity Pool (‘SSCIP’) to securely view and pay a SSCIP bill online. SSCIP’s administrator, Berkley Risk Administrators Company, LLC (‘Berkley Risk’), has licensed the right to use this service from an unaffiliated third-party, Wells Fargo Bank, N.A. and/or its affiliates (“Wells Fargo”).

Registration Credentials: To access E-bill Express, a User ID and password are required. To create a User ID and password on this site, Berkley Risk will provide you with an account number and a pin. This information is delivered securely and independently from this registration process. This information should be kept in a secure location as it is used to validate your identity when creating an account and registering for a User ID and Password within E-Bill Express. If you have reason to believe the pin information was not delivered securely or its confidentiality was compromised, you will notify Berkley Risk immediately.

User ID and Password: Berkley Risk and SSCIP are entitled to act on all instructions received under your User ID and password and you assume full responsibility for such instructions. You will keep your User ID password confidential, not disclose this information to anyone not authorized to access your account, and to notify Berkley Risk immediately if you believe someone else has obtained your User ID and password or any unauthorized access to the online service site has occurred or may occur.

Access: Berkley Risk and SSCIP may block access to E-Bill Express without prior notice if there is cause to believe your User ID and password are being used by someone other than you, if any unauthorized access to your personal information has occurred or may occur, or for other reasons.

Liability for Failure to Complete Transactions: E-Bill express will use commercially reasonable efforts to process your bill payments in accordance with your payment instructions. However, SSCIP and Berkley Risk shall incur no liability if a bill payment is not made in a timely manner or if any payments initiated by you through this service cannot be completed because:

· there is a hold or insufficient funds on your payment card or payment account

· any mishandling or processing of the payment as a credit to your account

· the E-Bill express services are not working properly and you know or have been advised by Berkley Risk or Wells Fargo about the circumstance

· you do not provide all required information, or

· circumstances over which Berkley Risk has no control including loss of internet access, loss of access to the credit card processing platform, acts of God, terrorism, regulatory or legislative changes, strikes work stoppages, or other similar occurrences or circumstances.
