The Atoka Funding website services are information services (henceforward: Atoka Funding information services) that are provided by Atoka Funding and the Atoka Funding group companies (henceforward: Atoka Funding Group) the use of which is subject to the following Terms of Service.
By accessing the Atoka Funding information services and using their content, you acknowledge and agree that you have read and understood the following terms of use and agree to be bound by them. Do not use the Atoka Funding Website if you do not agree with these terms.

We expressly disclaim any liability, whether in contract, tort, strict liability or otherwise, for any direct, indirect, incidental, consequential, punitive or special damages arising out of or in any way connected with your accessing or using or inability to access or use the Atoka Funding information services or your reliance on its content, or any failure of performance, interruption, defect, delay in transmission, computer viruses or other harmful components, or line or system failure associated with the Atoka Funding information services, regardless of our knowledge thereof. For your convenience certain hyperlinks or referenced websites in the Atoka Funding information services may take you to third parties' websites, which generally are recognized by their top level domain name. In the event that any provision of these terms is held unenforceable, the validity or enforceability of the remaining provisions will not be affected, and the unenforceable provision will be replaced with an enforceable provision that comes close to the intention underlying the unenforceable provision.
Terms and Conditions
The Online Payment Terms constitute a contract between you and Atoka Funding. Please read them carefully. You may either accept or decline the Terms as indicated at the bottom of this page, but to make payment using the Services you must accept the Terms by clicking “I Accept”. All payments of North Mill invoices using the online credit card facilities are subject to the following conditions. Atoka Funding accepts the following cards:

· Discover
· MasterCard
· Visa
You warrant that:
· You are 18 years of age or over.
· You have the appropriate authority to validly accept the Online Payment Terms and are able to and will meet your obligations in relation to these Terms.
· The credit card used in connection with the Services is issued in your name or you are authorized to use the credit card.
· You will pay the credit card issuer all charges incurred in the use of the Services.
· The information supplied by you is true and correct.
When you complete the online payment form, funds will be deducted from your credit card in USD currency. All payments are debited to Atoka Funding. Due to the way transactions are processed by the external banking sites, there may be delays of 1-3 days in updating your payment in Atoka Funding’s records. Credit card payments are secure:
· Credit card numbers are protected with a high level of encryption when transmitted over the Internet.
· Atoka Funding does not store in any way your credit card details.
Confirmation:
· If successful, you will receive a confirmation notice of your completed payment.
· If unsuccessful, you will be advised that your payment has failed. Atoka Funding will not be advised why a payment has failed; therefore, you should contact your credit card provider for details.
· If your payment fails, please use one of the other payment methods to pay your invoice. Please arrange an alternative payment method promptly to ensure continuous use.
· Atoka Funding will confirm your payment details via email.
By using Atoka Funding’s online credit card facilities, you accept and consent to your personal data being provided to the Service Provider for sole purpose of offering and administering the online payment. We respect the privacy of every individual who visits our site. The Atoka Funding websites have security measures in place to protect the loss, misuse and alteration of the information under our control. Atoka Funding’s Terms and Conditions for online credit card payments are subject to change at any time. Each transaction shall be subject to the specific Terms and Conditions that were in place at the time of the transaction. Important security note: Never transmit credit card information by e-mail.
Any payments made on this site will be applied first to any oldest monthly payment remaining open regardless of the items selected to be paid.
Fees
All transactions will be subject to a $10.00 service charge. Any returned check or dishonored payment shall be subject to a $50 fee payable by Debtor, but not more than permitted by law, to cover bank and administrative expenses incured by Secured Party.
